Advising a Defendant in a multi-billion pound claim brought by the Danish Tax Authority in relation to dividend withholding tax reclaims.
Advising Stobart Group Limited and its former directors in all aspects of its dispute with its former Chief Executive Officer, Andrew Tinkler, including advising the Company in relation to a hostile general meeting and attempt to remove the Chairman, advising on the termination and removal of an errant executive director and dealing the litigation which culminated in an expedited trial to determine liability. The court found that the Defendant had been lawfully dismissed and removed as a director, in a judgment which considered the responsibilities of directors in their interactions with the board and with shareholders. Stobart Group Ltd v Tinkler [2019] EWHC 258 (Comm). Mr Tinkler unsuccessfully subsequently tried to have that judgment set aside for fraud [2022] EWHC 1375 (Ch), [2023] EWCA Civ 655. The action was ultimately concluded when the Court struck out all of the remaining claims as an abuse of process [2024] EWHC 1490 (Ch).
